Alina Habba leaves her post in the wake of judicial disqualifies her service.
Alina Habba has resigned as the US Attorney for New Jersey. This comes after a legal ruling that invalidated her eligibility to occupy the role.
Acceptance of Resignation
US Attorney General, the Attorney General, announced Habba's resignation on Monday. Bondi stated that the court's "flawed" ruling made it impossible for the official to effectively run her office.
"Let no one confuse following the order as giving up," she declared. "The effort will now stretch across the nation."
Judicial Challenge
Habba's exit comes a week after a federal appellate panel ruled that she had been unlawfully serving as US attorney. This judgment is expected to impact numerous prosecutions in the Garden State.
The judicial panel said that a temporary posting that did not receive the advice and consent of the Senate violated the federal law governing appointments.
Next Steps and Responses
It was also stated that she will remain at the Department of Justice as a high-level advisor. She will seek further review of the disqualification, aiming for a reversal.
In a statement, Bondi wrote that the judiciary "should not be able to countermand the appointment of attorneys tasked with performing the fundamental role of the presidency of enforcing the law."
Performance in Office
The attorney general commended Habba's record and noted that while she was in charge, the state capital of Newark saw a significant drop in criminal activity. Additionally that the southern city of Camden had its initial homicide-free summer since 1974 with no murders.
Connection to Donald Trump
The 41-year-old attorney, originally became part of Trump's personal legal team in recent years. She later acted for the former president in his business records case in 2024, which resulted in his conviction on multiple felony counts of document fraud.
Before her appointment to the role of US Attorney, Trump had stated he was naming her as his presidential counsellor during his second administration, labeling Habba as a steadfast ally and a "tireless advocate for justice".
